DMCA Copyright Policy

This DMCA Copyright Policy applies to copyright owners and their authorized agents who believe that material available through fapsly.net infringes their copyrights, as well as to users who believe that their material was removed or disabled by mistake or misidentification.

fapsly.net does not actively monitor, screen, or pre-review all materials uploaded by users of the service. However, we take copyright infringement seriously and respond to valid notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512.

Copyright Infringement Notices

If you believe that copyrighted material is being used on fapsly.net without authorization from the copyright owner, the copyright owner’s agent, or the law, you may submit a written DMCA notice to:

To be valid, your DMCA notice should include the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notice, a representative list of those works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including information reasonably sufficient to allow us to locate the material, such as the specific URL or URLs on fapsly.net.
  4. Information reasonably sufficient to allow us to contact you, such as your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner’s agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Upon receiving a proper DMCA notice, we may remove or disable access to the allegedly infringing material as soon as reasonably practicable. We may also notify the user who uploaded or made available the affected material.

Counter-Notification

If you believe that your material was removed or disabled by mistake or misidentification, you may submit a written counter-notification to:

To be valid, your counter-notification should include the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, to the jurisdiction of any judicial district in which fapsly.net may be found.
  6. A statement that you will accept service of process from the person who submitted the original DMCA notice or that person’s agent.

After receiving a valid counter-notification, we may forward it to the party who submitted the original DMCA notice. If that party does not notify us that it has filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed or disabled material in accordance with the DMCA.

Repeat Infringer Policy

fapsly.net may terminate or restrict access to user accounts that are determined, in appropriate circumstances, to be repeat infringers. We may also remove or disable access to content and take other appropriate action where required by law or by our policies.

Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability.
